1. What Information Do We Collect?

In Short: We collect minimal personal information that you provide to us.

Notice is a local-first application. User-generated content (your name, moods, habits, reflections, and any custom settings) is stored on your device and is not transmitted to us. We do not maintain user accounts.

Sensitive Information. We do not process sensitive information.

Information automatically collected

In Short: Some technical information is collected automatically through our error-tracking service when issues occur.

The information we collect includes:

  • Log and Usage Data. When the application encounters an error, our crash-reporting service (Sentry) automatically collects diagnostic information including stack traces, error context, and performance metrics. This information helps us identify and fix bugs.
  • Device Data. When errors occur, we collect device data such as device model, operating system version, app version, and Internet Protocol (IP) address (which may be captured by Sentry).

2. How Do We Process Your Information?

In Short: We process your information to provide, improve, and administer our Services, for security and fraud prevention, and to comply with law.

We process your personal information for the following reasons:

  • To deliver and facilitate delivery of services. We process limited information to provide the requested Services.
  • To protect our Services. We may process diagnostic information to keep our Services safe and secure, including bug diagnosis and fraud prevention.
  • To save or protect an individual's vital interest. We may process information when necessary to save or protect an individual's vital interest, such as to prevent harm.

3. What Legal Bases Do We Rely On?

In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason.

The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on to process your personal information. As such, we may rely on the following legal bases:

4. When and With Whom Do We Share Your Personal Information?

In Short: We may share information in specific situations and with the following third parties.

Third-Party Service Providers. We have contracts in place with our third parties designed to safeguard your personal information. The third parties we may share information with are:

  • Functionality and Infrastructure Optimisation: Sentry (crash reporting) and Google Fonts (font delivery).
  • Invoicing and Billing: Apple Pay and RevenueCat.

We may also need to share your personal information in the following situations:

  • Business Transfers. We may share or transfer your information in connection with any merger, sale of company assets, financing, or acquisition of all or a portion of our business.

5. Is Your Information Transferred Internationally?

In Short: We may transfer, store, and process your information in countries other than your own.

Our third-party service providers may be located in the United States and Ireland. If you are a resident in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, these countries may not necessarily have data protection laws as comprehensive as those in your country. However, we will take all necessary measures to protect your personal information in accordance with this Privacy Notice and applicable law.

European Commission's Standard Contractual Clauses:

Our third-party service providers have implemented measures to protect personal information, including by using the European Commission's Standard Contractual Clauses for transfers of personal information between us and our third-party providers. These clauses require recipients to protect all personal information that they process originating from the EEA or UK in accordance with European data protection laws and regulations.

6. How Long Do We Keep Your Information?

In Short: We keep your information for as long as necessary to fulfil the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law:

  • User-generated content (moods, habits, reflections): Stored on your device only and retained until you delete the data through the app or uninstall the app.
  • Crash and error reports collected via Sentry: Retained for up to 90 days.
  • Subscription transaction data: Retained while the subscription is active and for 7 years thereafter for legal, accounting, and tax purposes.

7. How Do We Keep Your Information Safe?

In Short: We aim to protect your personal information through a system of organisational and technical security measures.

User data is stored using iOS's native secure storage, protected by iOS's whole-device encryption when the device has a passcode set. Communications with our third-party services (RevenueCat, Sentry, Apple) use TLS/HTTPS encryption.

However, despite our safeguards, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorised third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information.

8. Do We Collect Information From Minors?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or the equivalent age as specified by law in your jurisdiction, or that you are the parent or guardian of such a minor and consent to the minor's use of the Services. In Short: Depending on your location, applicable privacy law may grant you rights including the right to access, correct, or delete your personal information.

In some regions (like the EEA, UK, Switzerland, and Canada), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; (iv) if applicable, to data portability; and (v) not to be subject to automated decision-making.

10. Controls for Do-Not-Track Features

Most web browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature you can activate to signal your privacy preference. As Notice is a native mobile application that does not engage in cross-site or cross-app tracking, DNT signals do not apply. We do not currently respond to DNT browser signals.

11. Do United States Residents Have Specific Privacy Rights?

In Short: If you are a resident of various US states (including California, Colorado, Connecticut, Virginia, Texas, and others), you may have specific rights regarding access, correction, and deletion of your personal information.

Notice does not collect the categories of personal information typically regulated under US state privacy laws. We do not sell personal information, do not engage in targeted advertising, and do not profile users for legal or significant effects.

Categories of personal information we collect: We collect limited diagnostic information through our crash reporting service (device data, log and usage data). We do not collect names, contact details, financial information, biometric information, geolocation, audio or visual recordings, professional information, education records, or inferences for profiling purposes.

In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.

We may update this Privacy Notice from time to time. The updated version will be indicated by an updated "Last updated" date at the top of this Privacy Notice. If we make material changes, we may notify you either by prominently posting a notice or by directly sending you a notification. We encourage you to review this Privacy Notice frequently.
